you guys pick up on the finest details and always push me off in the right direction.
My pops said "as soon as you left us old timers alone the crank dropped down into the upper case" so it must of just been stuck on a seal of some sort. cant wait to get down there and put this thing back together how its supposed to be. im a little nervous on what else the previews owner may have done wrong but the engine seems to start and run as good as my CA.

Now that you are in there you may want to look at a couple of other parts for ware.
14mm brass bushing, kick starter pawl, shift fork contact ends and consider replacing all seals. ..................lm

I put mine in upside down as well. Thanks for the thread 'cause I would of continued to assemble my engine. Took mine apart last night...will get it back together within the week.

Thanks LM! i just bought the seal kit and will happily take your advice on the other items mentioned.
